The ninth circuit court has upheld a prohibition on deploying national guard in Portland, Oregon, after a recent court ruling.

Judicial Panel Agrees to Reconsider Case

The federal appeals court decided on Tuesday that it would rehear the legal dispute concerning the executive power with an expanded panel of 11 judges. The judicial body also vacated a previous ruling from a smaller judicial group that had sided with the federal government.

Ongoing Dispute Over Military Presence

This order represents the most recent development in a protracted court case over whether the administration has the authority and justification to deploy state military units in Portland. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was started in response to ongoing demonstrations.

Differing Viewpoints

The administration has argued that federal officials at the ICE facility in the southern part of the city were under attack, while city and state officials assert that municipal police have command of the situation.

In defiance of characterizations of Portland as “war ravaged”, residents have been posting videos of lush hiking trails and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The appeals court decision came after a US district judge in Portland enacted two legal injunctions this month – one blocking the federal control of the Oregon national guard, and another stopping the use of any national guard troops in the state, after efforts to circumvent the initial injunction by mobilizing troops from California.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting control of state troops – but the subsequent injunction stayed effective, blocking the physical sending of the troops.

Full Panel Consideration

The Tuesday decision means the matter will be heard by the full court – with both rulings under consideration together – by a group of eleven justices.

“This ruling shows that facts are important and that the judicial system are working to hold this administration accountable. The founding document limits the president’s power, and Oregon’s communities cannot be treated as a testing site for expansive government power,” stated the state attorney general in a statement.

“The judicial body is sending a clear message: the executive leader cannot send the military into American urban areas without cause. We will continue defending state legislation, values, and sovereignty as this legal proceeding progresses and our fight continues in the courts.”
